Specialty

Nelson O. Melgar Martinez, Esq. specializes in the areas of family law and immigration. He has successfully represented clients in uncontested divorce cases, guardianship proceedings, and child custody and support disputes. Nelson has also helped clients pursue U.S. citizenship, legal permanent resident status, Special Immigrant Juvenile Status (“SIJS”), and Deferred Action for Childhood Arrivals (“DACA”). His experience includes removal defense, bond redetermination, and appeals to the Board of Immigration Appeals (“BIA”).

History

Prior to attending law school, Nelson spent years as an immigrant rights activist, with particular focus on the passage of the New York State Dream Act and a federal comprehensive immigration reform. His years as an activist and community leader gave him a firsthand and unique understanding of the legal and human hurdles his clients face—and fuel his commitment as an attorney to serve his clients with integrity, respect, empathy, and compassion.

Education

Nelson attended New York Law School, where he was a member of the Moot Court Association; the first Latino and evening division student to be elected president of the Student Bar Association, and the founder of the school’s chapter of the Federal Bar Association for the Southern District of New York. He is admitted to practice law in the state of New York and the Southern District of New York.

Objective

Nelson’s many years as an activist resulted in a deep familiarity with—and strong connection to—the immigrant communities of Long Island. His Spanish fluency allows him to offer bilingual legal services, bolstered not only by a clear appreciation of the clients’ legal issues but also by a superb ability to explain the law in terms and the language the clients can understand. Indeed, Nelson approaches the practice of law with the personable, strategic, and assertive approach that so characterized his years as an activist and community leader.
